Contract specifications
6. Contract description: Under the contract, contractors will be expected
to design, manufacture, deliver, assemble, install and commission the
following items: transformers, control and protection equipment, various
other equipment.
The contract entails:
a firm phase to:
— set up the 4th 90/16,5 kV 36 MVA transformer bay at the Abobo post,
— set up the 3rd 90/16,5 kV 36 MVA transformer bay at the Riviera post,
— supply, assemble and install a 90/16,5 kV 50 MVA transformer at the
Treichville post,
— set up the 3rd 90/16,5 kV 36 MVA transformer bay at the Vridi post;
and an optional phase to:
— supply and assemble a 90/16,5 kV 50 MVA transformer and a 90/16,5 kV 36
MVA transformer at the maintenance pool.
Award of the optional phase will depend on available resources.
7. Number and titles of lots: The contract has not been split into lots.
Conditions for participation
8. Eligibility and rule of origin: Participation in the contract
procedure is open on equal terms to natural persons and legal entities
(irrespective of whether they are taking part as individuals or as part of
a grouping (consortium) of tenderers) from the ACP countries and the
Member States of the European Union who contribute to the European
Development Fund, and also to international organisations as authorised by
the instrument applicable to the programme under which the contract is
financed (see point 22). All the goods supplied under this contract must
originate in 1 or more of these countries.
9. Grounds for exclusion: Tenderers must submit a declaration stating
that they are not in any of the situations listed in section 2.3.3 of the
Practical Guide to contract procedures in the context of external actions.
10. Number of tenders: Tenderers can only submit 1 tender. Tenders for
part of a lot will not be considered. Tenderers may state in their tender
whether they would grant a discount should they be awarded several lots.
Tenderers cannot submit a variant tender in addition to their tender for
the supplies required in the invitation to tender dossier.
11. Tender guarantee: Tenderers must provide a tender guarantee of XOF 70
000 000 when they submit their tender. This will be returned to
unsuccessful tenderers once the invitation to tender procedure has been
completed and to the successful tenderer(s) once the contract has been
signed by all parties. This guarantee will be drawn on if the tenderer
does not honour all the obligations stipulated in the invitation to
tender.
12. Performance bond: The successful tenderer will be required to provide
a performance bond for 10 % of the contract value when the contract is
signed. The bond must be furnished within 30 days of the date on which the
tenderer receives the contract signed by the contracting authority. If the
successful tenderer does not furnish the bond within the time allowed, the
contract will be rendered void and a new contract may then be drawn up and
sent to the tenderer with the second best compliant tender.
13. Briefing and/or site visit: Briefings and site visits will take place
from 15.7.2008 to 18.7.2008 as per the following schedule:
15.7.2008 (9:00-11:00): briefing at the Cellule de coordination de la
coopération Côte d'Ivoire/Union européenne (Côte d'Ivoire/European Union
Cooperation Coordination Unit);
15.7.2008 (11:30-12:30): visit to the Treichville post;
15.7.2008 (14:30-18:30): visit to the Abobo and Riviera posts;
16.7.2008 (9:00-11:30): visit to the Vridi post;
18.7.2008 (9:00-11:00): final briefing at the Cellule de coordination de
la coopération Côte d'Ivoire/Union européenne (Côte d'Ivoire/European
Union Cooperation Coordination Unit).
Place: Cellule de coordination de la coopération Côte d'Ivoire/Union
européenne, immeuble Jeceda, entrée A, 3e étage, avenue Marchand,
Abidjan-Plateau, 01 BP V 306, Abidjan 01.

14. Tender validity: Tenders are to be valid for 90 days from the final
date for submission of tenders.
15. Implementation period: The performance period runs from October 2008
to December 2010.
Selection and award criteria
16. Selection criteria: The following selection criteria will be applied
to tenderers. Where tenders are submitted by a consortium, these criteria
will apply to the consortium as a whole.
1) Tenderers' economic and financial capacity (based on point 3 of the
tender form for a supplies contract):
(a) reference criterion a: tenderers must have a total turnover for the
past 3 years of at least F CFA 7 500 000 000;
(b) reference criterion b: tenderers must have access to sufficient credit
and other financial facilities to ensure that they have the required cash
flow throughout the contract period. They must, in any case, have access
to credit in excess of the equivalent of 30 % of the tender value;
(c) reference criterion c: tenderers must furnish summaries of balance
sheets and trading accounts for the past 3 years certified by an
authorised chartered accountant in the country in which they reside.
2) Tenderers' professional capacity (based on points 4 and 5 of the tender
form for a supplies contract):
(a) reference criterion a: tenderers must have a business activity related
to this contract (proof of enrolment on the trade register and a list of
work carried out in the past 10 years must be provided);
(b) reference criterion b: tenderers' essential staff to be responsible
for assembly and installation of the electromechanical equipment and
carrying out the civil engineering and building works must comprise the
following:
— 1 head of mission: electrical engineer or equivalent (at least 5 years
of higher education) with 10 years' specific professional experience. He
must have been head of mission for at least 1 project involving the
supply, assembly, installation and commissioning of a 90/16,5 kV
transformer bay, or have equivalent experience,
— 1 specialist in civil engineering and building works: engineer with at
least 3 years' experience or senior technician with at least 5 years'
experience,
— 4 general foremen (i.e. 1 per site) with, as a minimum, training as
senior technicians in the field of electrical or electromechanical
engineering, each with 5 years' professional experience.
Tenderers must also enclose copies of CVs and photocopies of
qualifications for staff, in addition to copies of employers'
certificates, in order that their specific professional experience may be
judged. CVs must list similar projects already carried out, including the
site and the name and address of the awarding authority, in accordance
with the model in part C of the invitation to tender dossier,
— 1 trainer: tenderers must also furnish a CV for the trainer (from the
training team of the equipment manufacturer), who must have at least 1
year's practical experience of the equipment for which he will be
providing training, as specified in point 11 of the instructions to
tenderers in the invitation to tender dossier.
3) Tenderers' technical capacity (based on points 5 and 6 of the tender
form for a supplies contract):
(a) reference criterion a: tenderers must have successfully carried out at
least 1 contract during the past 10 years to supply, assemble, install and
commission a 90/16,5 kV transformer bay in operating conditions, or an
equivalent contract (satisfactory performance certificates must be
provided);
(b) reference criterion b: tenderers must indicate the resources in terms
of equipment and the specific machinery (a list must be provided including
the function of the machinery) they will have at their disposal to carry
out the contract. As a minimum, this list must include:
— 1 lifting machine adapted for the weight of transformers,
— 1 concrete mixer,
— 1 complete tool kit including torque wrenches,
— 1 coupling machine,
— 1 bending machine,
— 1 electric field probe;
(c) reference criterion c: if the tenderer is not the manufacturer of the
equipment figuring in the contract, a commitment signed by the
manufacturer must be included as part of the tender stating that he is
severally liable for management of the warranty for all faults relating to
the manufacture of the equipment.
The equipment in question is as follows:
— the 90/16,5 kV, 36 MVA transformer,
— the 90/16,5 kV, 50 MVA transformer,
— the 90 kV, 1250 A 3-pole circuit breaker,
— the 630 mm CIS cable, 12/20 kV Alu NFC 33-C226,
— the 240 mm CIS cable, 12/20 kV Alu NFC 33-C226,
— the protection and control equipment,
— the telecontrol equipment,
— the metal-clad bays: a sole commitment should be provided for the
metal-clad bays (outgoing feeder bay HTA 24 kV, 400A; incoming feeder bay
HTA 24 kV, 1250A; coupling bay 24 kV, 1250A; bar bridge bay HTA 24 kV,
1250A; bar voltage transformer bay);
(d) reference criterion d: a draft work programme covering the main areas
of the services and work. This programme should highlight the main stages
of service provision, in particular the deadline for delivery of the
supplies, the different manufacturing stages, the various laboratory
tests, time taken to transport equipment, etc. This programme must not
exceed the performance period for the tasks;
(e) reference criterion e: tenderers must provide a description of the
site organisation and the methodology used to carry out the services in
the factory and on site.
Economic operators may, if necessary and for a specific contract, make use
of the capacities of other bodies irrespective of the legal nature of the
connection between themselves and said bodies. In such an event, they must
provide the contracting authority with proof that they will have the
resources needed to carry out the contract by, for example, producing a
written commitment by said bodies to make such resources available. These
bodies must comply with the same eligibility rules, in particular
regarding nationality, as the economic operator in question.
17. Award criteria: The sole award criterion will be price. The
lowest-priced tender deemed to be compliant will be accepted.
The price will be the result of the total value of the activities
(installation, assembly, commissioning, training) and the
electromechanical supplies and works.
For the transformers, the price used will be the comparison price (Ca)
calculated using the following formula:
Ca = Co + 1158000*Pv + 715000*Pc;
Ca: tenderers' comparison price in F CFA;
Co: adjusted value of the tender in F CFA;
Pv: tenderers' guaranteed no-load loss kW rating;
Pc: tenderers' guaranteed load loss or copper loss kW rating.
Tender submission
18. Procedures for obtaining the invitation to tender dossier: The
invitation to tender dossier is available from the following web address:
http://ec.europa.eu/europeaid/cgi/frame12.pl.
It can also be obtained from the contracting authority. The standard
tender form for a supplies contract must be used to draw up tenders. This
form can be found in the invitation to tender dossier, and its clauses and
format must be strictly adhered to.
Questions regarding this invitation to tender must be sent in writing,
quoting the publication reference in point 1, to:
