in the Gambia.
Contract specifications
6. Description of the contract: Supply, installation, commissioning,
after-sales services for solar water pumping systems; the supply and
delivery of various water supply equipment and materials; the supply and
installation of elevated water-storage tanks; to the Department of Water
Resources in the Gambia under the RWSSS programme.
7. Number and titles of lots: 4.
Lot 1:
— supply of 55 hand pumps,
Lot 2:
— supply, installation, commissioning, after-sales services for 5 years
for 25 solar water-pumping systems,
— supply of submersible pumps for 5 boreholes,
— supply of control panels for 5 boreholes,
Lot 3:
— supply and installation of 28 elevated water-storage tanks,
— supply of required materials and rehabilitation of 4 elevated storage
tanks,
Lot 4:
— supply of headwork arrangements for 5 boreholes,
— supply of various pipes and fitting,
— supply of various borehole drilling/construction materials for 5
boreholes,
— supply of riser pipes and accessories for 5 boreholes.
Terms of participation
8. Eligibility and rules of origin: Participation in tendering is open on
equal terms to natural and legal persons (participating either
individually or in a grouping (consortium) of tenderers) from ACP States
and Member States of the European Union contributing to the European
Development Fund and international organisations as authorised by the
instrument applicable to the programme under which the contract is
financed (see also item 22 below). All goods supplies under this contract
must originate in these countries.
9. Grounds for exclusion: Tenderers must submit a statement to the effect
that they are not in any of the situations listed in point 2.3.3 of the
'Practical Guide to contracts procedures for EC external actions'.
10. Number of tenders: Tenderers may submit only 1 tender for a lot.
Tenders for parts of the lot will not be considered. Any tenderer may
state in its tender that it would offer a discount in the event that its
tender is accepted for more than 1 lot. Tenderers should not submit a
tender for a variant solution in addition to their tender for the supplies
required in the tender dossier.
11. Tender guarantee: Tenderers must provide a tender guarantee of 2 % of
the total amount tendered when submitting their tender. This guarantee
will be released to unsuccessful tenderers once the tender procedure has
been completed and to the successful tenderer(s) upon signature of the
contract by all parties. This guarantee will be called upon if tenderers
do not fulfil all obligations stated in their tender.
12. Performance guarantee: The successful tenderer will be asked to
provide a performance guarantee of 10 % of the amount of the contract at
the signing of the contract. This guarantee must be provided no later than
30 days after the tenderer receives the contract signed by the contracting
authority. If the selected tenderer fails to provide such a guarantee
within this period, the contract will be void and a new contract may be
drawn up and sent to the tenderer which has submitted the next-best
compliant tender.
13. Information meeting and/or site visit: A clarification/site meeting
will be held on 18.8.2008 (10:00) at The Department of Water Resources, 7
Marina Parade, Banjul, the Gambia to answer any questions on the tender
dossier which have been forwarded in writing or are raised at the meeting.
14. Tender validity: Tenders must remain valid for a period of 90 days
after the deadline for submission of tenders.
15. Period of performance: The performance period is 4 months from
signing of the contract by all parties. However, in the case of the
components requiring installation lots 1 and 2 (solar water-pumping
systems and elevated water tanks), an additional 4 months would be given
for the installation of these supplies.
Selection and award criteria
16. Selection criteria: The following selection criteria will be applied
to tenderers. In the case of tenders submitted by a consortium, these
selection criteria will be applied to the consortium as a whole:
1) Economic and financial capacity of tenderer (based on i.e. item 3 of
the tender form for a supply contract):
(a) the average annual turnover of the tenderer must exceed 3 times the
financial proposal of the tender;
(b) the free credit line of the tenderer must be at least 50 % of the
financial proposal of the tender;
2) Professional capacity of tenderer (based on i.e. items 4 and 5 of the
tender form for a supply contract):
— the tenderer shall submit certified references from clients with at
least 2 clients for previous similar supplies;
3) Technical capacity of tenderer (based on i.e. items 5 and 6 of the
tender form for a supply contract):
(a) the tenderer has successfully completed at least 2 contracts with a
budget of at least that of this contract in the past 7 years;
(b) the tenderer has worked successfully on at least 2 projects in fields
related to this contract in the past 7 years.
An economic operator may, where appropriate and for a particular contract,
rely on the capacities of other entities, regardless of the legal nature
of the links which it has with them. It must in that case prove to the
contracting authority that it will have at its disposal the resources
necessary for performance of the contract, for example by producing an
undertaking on the part of those entities to place those resources at its
disposal. Such entities must respect the same rules of eligibility and
notably that of nationality, as the economic operator.
17. Award criteria: For supply contracts without a service component, the
sole award criterion shall be the price. The contract will be awarded to
the lowest compliant tender.

The tender dossier is also available for collection from the contracting
authority. Tenders must be submitted using the standard tender form for a
supply contract included in the tender dossier, whose format and
instructions must be strictly observed.

19. Deadline for submission of tenders: All tenders must be received at
the Department of Water Resources, 7 Marina Parade, Banjul, the Gambia
before 3.10.2008 (12:00), by registered letter with acknowledgement of
receipt or hand-delivered against receipt signed by the Coordinator of
RWSSS, Department of Water Resources or his representative.
Any tender received after this deadline will not be considered.
20. Tender opening session: Tenders will be opened in public session on
the date indicated in item 19 (3.10.2008 (12:30)), at the Conference Room,
Department of Water Resources, 7 Marina Parade, Banjul, the Gambia, by the
committee appointed for the purpose. The committee will draw up minutes of
the meeting, which will be available on request.
21. Language of the procedure: All written communications for this tender
procedure and contract must be in English.
22. Legal basis: ACP-EC Partnership Agreement signed at Cotonou on
23.6.2000 as amended on 25.6.2005.
Decision No 2/2002 of the ACP-EC Council of Ministers published in OJ L
320 of 23.11.2002.
