Contract specifications
6. Contract description: The object of this invitation to tender is to
enter into a supplies contract, with 3 separate lots, for educational
materials for pupils and teachers, for the Ministry of Education in the
Republic of Angola.
7. Number and titles of the lots: Lot 1 — reproduction of educational
materials for pupils and teachers in the first-level class, on Portuguese
language, mathematics, environmental studies and manual work and plastic
arts.
Lot 2 — reproduction of educational materials for pupils and teachers in
the second-level class, on Portuguese language, mathematics, environmental
studies, manual work and plastic arts, and first-level/second-level
physical education.
Lot 3 — reproduction of educational materials for pupils and teachers in
the third-level class, on Portuguese language and mathematics.
Conditions for participation
8. Eligibility and rule of origin: Participation in the invitation to
tender is open on equal terms to all natural persons and legal entities
(irrespective of whether they are taking part as individuals or as part of
a grouping (consortium) of tenderers) from the ACP countries or the EU
Member States who contribute to the European Development Fund, and to
international organisations authorised by the specific instruments
applicable to the programme under which the contract is financed (see also
point 22). All the goods supplied under this contract must originate in
these countries.
9. Grounds for exclusion: Tenderers must submit a declaration stating
that they are not in any of the situations referred to in section 2.3.3 of
the Practical Guide to contract procedures for EC external actions.
10. Number of tenders: Tenderers may only submit 1 tender per lot.
Tenders for part of a lot will not be considered. Tenderers may state in
their tenders whether they are prepared to grant a discount should their
tender be accepted for more than 1 lot. Tenderers cannot propose a variant
tender in addition to their tender for the supplies required in the
invitation to tender.
11. Tender guarantee: Tenderers must provide a tender guarantee for 2 %
of the tender value when they submit their tenders. The guarantee will be
returned to unsuccessful tenderers after the invitation to tender
procedure has been completed, and to the successful tenderer(s) once the
contract has been signed by all parties. It will be drawn on if tenderers
do not comply with the obligations stated in the tender.
12. Performance bond: Upon signing the contract, the successful tenderer
must furnish a performance bond for 5 % of the contract value. This
guarantee must be furnished within 30 days of the date on which he
receives the contract signed by the contracting authority. If the
successful tenderer does not furnish the aforementioned bond within the
time allowed, the contract will be considered null and void and a new
contract will be drawn up and sent to the tenderer who submitted the next
most suitable compliant tender.
13. Briefing and/or site visit: There are no plans to organise a
briefing.
14. Tender validity period: Tenders must remain valid for 90 days from
the final date for submission of tenders.
15. Delivery period: 120 days from the date of contract signature — or
alternatively — until provisional acceptance.
Selection and award criteria
16. Selection criteria: The following selection criteria will be applied
to tenderers. Where tenders are submitted by a consortium, these criteria
will apply to the consortium as a whole.
(1) Tenderers' economic and financial capacity (based on point 3 of the
application form for a supplies contract):
tenderers' turnover in the past 2 years must have been at least twice the
value of the present contract.
(2) Tenderers' professional capacity (based on points 4 and 5 of the
application form for a supplies contract):
tenderers must have been awarded at least 2 contracts with a similar level
of technicality to this contract in the past 2 years.
(3) Technical capacity (based on points 5 and 6 of the application form
for a supplies contract):
economic operators may, where necessary and for a specific contract, make
use of the capacities of other bodies, irrespective of the legal nature of
the connection between themselves and said bodies. In such a case, they
must provide the contracting authority with proof that they will have the
resources needed to carry out the contract by, for example, producing a
signed commitment from said bodies to make such resources available. These
entities must respect the same eligibility rules as the economic operator,
particularly with regard to nationality.
17. Award criteria: Price (or, where appropriate, subject to prior
approval, the economically most advantageous tender with a suitable
service quality/price ratio).
Tender submission procedures
18. Procedures for obtaining the invitation to tender dossier: The
invitation to tender dossier can be obtained from the following web
address: http://ec.europa.eu/europeaid/work/procedures/implementation/
supplies/index_en.htm. It is also available from the contracting
authority. Tenders must be submitted on the standard application form for
a supplies contract found in the invitation to tender dossier, and the
format and instructions therein must be strictly adhered to.
Tenderers who have questions concerning this invitation to tender should
send them in writing (quoting the publication reference in point 1) to the
following address:

They must be sent at least 21 days prior to the final date for submission
of tenders given in point 19, and the contracting authority must reply no
later than 11 days before said final date for submission of tenders. Any
clarifications regarding the invitation to tender will be published on the
EuropeAid web site (http://ec.europa.eu/europeaid/cgi/frame12.pl).
19. Final date for submission of tenders: 22.9.2008 (10:00), local time
in the Republic of Angola.
Tenders received after this deadline will not be considered.
20. Tender opening session: Tenders will be opened in public on 22.9.2008
(11:30), local time, in Luanda, on the premises of the Ministério da
Educação, Avenida Comandante Gika, Largo António Jacinto, 1.° andar.
21. Language to be used: All correspondence regarding this invitation to
tender procedure and the contract must be in Portuguese.
22. Legal basis: ACP-EC Partnership Agreement signed in Cotonou on
23.6.2000 and revised on 25.6.2005.
Decision No 2/2002 of the ACP-EC Council of Ministers published in OJ L
320 of 23.11.2002.
