Contract specifications
6. Contract description: The contract involves construction of a
perimeter fence: approximately 17 km.
The fence must be floodlit and have security features.
7. Number and titles of lots: The contract comprises 1 lot.
Conditions for participation
8. Eligibility and rule of origin: Participation in the contract is open
on equal terms to natural persons and legal entities from the ACP
countries and the Member States of the European Union who are signatories
to the revised 4th Lomé Convention, with the exception of not-for-profit
companies and associations. All works, supplies and services must come
exclusively from these countries.
9. Grounds for exclusion: Tenderers must sign and submit the declaration,
included with the tender form for a works contract, confirming that they
are not in any of the situations listed in Article 4.2. of the general
regulations and general conditions for contracts financed by the European
Development Fund (Decision No 3/90 of the ACP-EC Council of Ministers of
20.3.1990).
10. Number of tenders: Tenderers can only submit 1 tender. Tenders for
part of the lot will not be considered.
11. Tender guarantee: Tenderers must provide a tender guarantee for EUR
15 000 when they submit their tender. This will be returned to
unsuccessful tenderers once the invitation to tender procedure has been
completed and to the successful tenderer(s) once the contract has been
signed by all parties. This guarantee will be drawn on if the tenderer
does not honour all the obligations stipulated in the invitation to
tender.
12. Performance bond: The successful tenderer will be required to provide
a performance bond for 10 % of the contract value when the contract is
signed. The bond must be furnished within 30 days of the date on which the
tenderer receives the contract signed by the contracting authority. If the
successful tenderer does not furnish the bond within the time allowed, the
contract will be rendered void and a new contract may then be drawn up and
sent to the tenderer with the second best compliant tender.
13. Briefing and/or site visit: A mandatory briefing and site visit shall
take place on 6.10.2008 at Bujumbura international airport. The meeting
point is in the conference room of the Directorate of the 'régie des
services aéronautiques (RSA)'. The contact person is the Director of the
RSA.
14. Tender validity: Tenders are to be valid for 90 days from the final
date for submission of tenders.
15. Time limit for completion: The period allocated for performance of
the works is 9 calendar months from signature of the contract by the
successful tenderer.
Selection and award criteria
16. Selection criteria: Tenderers must meet the minimum selection
criteria as described in paragraph 4.2 of the instructions for tenderers
below.
17. Award criteria: Tenderers must meet the conditions described in
paragraph 31 of the instructions for tenderers below.

18. Procedures for obtaining the invitation to tender dossier: The
invitation to tender dossier can be obtained from:

Illustrated documents, such as plans, can be obtained from the 'Cellule
d'appui à la gestion des fonds de contrepartie du Stabex', avenue du
Large, tel. (257) 22 21 47 58, on submission of a receipt for the transfer
of BIF 100 000 to account No 201-0023656-35/BIF at the 'Banque de crédit
de Bujumbura'. It can also be consulted on the premises of the 'cellule
Stabex'. The standard tender form enclosed with the invitation to tender
dossier must be used to draw up tenders, and the clauses and format of
this form must be strictly adhered to.
Questions concerning this invitation to tender must be addressed in
writing to the 'Cellule Stabex', BP 1383. Tel. (257) 22 21 47 58. E-mail:
stabexbu@cbinf.com (quoting the publication reference given in point 1) at
least 21 days before the final date for submission of tenders, given in
point 19. The contracting authority must reply at least 11 days before the
final date for submission of tenders.
Clarifications concerning the invitation to tender dossier may be

19. Final date for submission of tenders: 3.11.2008 (8:00).
Tenders received after this deadline will not be considered.
20. Tender opening session: Tenders will be opened in public on 3.11.2008
(9:30) in the conference room of the 'Cellule de l'ordonnateur national du
FED' (CELON), Bujumbura, avenue de la Grèce n° 42 bis, BP 462. Tel. (257)

21. Language for the procedure: French must be used for all
correspondence concerning this invitation to tender.
22. Legal basis: Revised 4th Lomé Convention.
Decision No 3/90 of the ACP-EC Council of Ministers of 29.3.1990 adopting
the general regulations and general conditions for contracts financed by
the European Development Fund (EDF).
