Contract specifications
6. Contract description: Supply of 57 vehicles.
7. Number and titles of lots: The contract is divided into 4 lots, as
follows:
lot 1: 28 all-terrain 4 × 4 estate cars, 25 of which are for the programme
to support good governance (PABG), 2 for the post-conflict,
rural-development programme (PPCDR), and 1 for the Healthcare Plus
project;
lot 2: 15 all-terrain double-cabin 4 × 4 vehicles, 2 of which are for the
support unit to the EDF National Authorising Officer (CELON), 6 for the
PPCDR, and 7 for the Healthcare Plus project;
lot 3: 9 all-terrain single-cabin 4 × 4 vehicles for the Healthcare Plus
project;
lot 4: 5 saloon cars, 2 of which are for the PPCDR, 2 for the Healthcare
Plus project, and 1 for the Arcane project.
Tenderers may submit tenders for 1, several, or all of the lots.
Conditions for participation
8. Eligibility and rule of origin: Participation in the contract is open
on equal terms to all natural persons and legal entities (irrespective of
whether they are taking part as individuals or as part of a grouping
(consortium) of tenderers) that meet the required financial and technical
criteria.
By derogation, the equipment is not subject to any rule of origin.
9. Grounds for exclusion: Tenderers must submit a declaration stating
that they are not in any of the situations listed in section 2.3.3 of the
Practical Guide to contract procedures in the context of external actions.
10. Number of tenders: Tenderers cannot submit more than 1 tender per
lot. Tenders for part of a lot will not be considered. Tenderers may state
in their tender whether they would grant a discount should they be awarded
several lots. Tenderers cannot submit a variant tender in addition to
their tender for the supplies required in the invitation to tender
dossier.
11. Tender guarantee: Tenderers must furnish a tender guarantee for:
lot 1: EUR 12 000;
lot 2: EUR 4 500;
lot 3: EUR 2 700;
lot 4: EUR 960;
when they submit their tenders. This guarantee will be returned to
unsuccessful tenderers once the invitation to tender procedure has been
completed and to the successful tenderer after the contract has been
signed by all parties. This guarantee will be drawn on if the tenderer
does not honour all the obligations stipulated in the invitation to
tender.
12. Performance bond: The successful tenderer will be required to provide
a performance bond for 5 % of the contract value when the contract is
signed. The bond must be furnished within 30 days of the date on which the
tenderer receives the contract signed by the contracting authority. If the
successful tenderer does not furnish the bond within the time allowed, the
contract will be rendered void and a new contract may then be drawn up and
sent to the tenderer with the second best compliant tender.
13. Briefing and/or site visit: There are no plans for a briefing.
14. Tender validity: Tenders are to be valid for 90 days from the final
date for submission of tenders.
15. Implementation period: 60 days maximum.
Selection and award criteria
16. Selection criteria: The following selection criteria will be applied
to tenderers. Where tenders are submitted by a consortium, these criteria
will apply to the consortium as a whole.
1) Tenderers' economic and financial capacity (based on point 3 of the
tender form for a supplies contract):
— an average annual turnover, for the past 2 years and the current year,
of at least double the amount of this contract,
— an overall cash surplus.
2) Tenderers' professional capacity (based on points 4 and 5 of the tender
form for a supplies contract):
— tenderers must have a minimum of 20 qualified, permanent staff working
in the manufacture, fitting out, assembly or marketing and maintenance of
the vehicles.
3) Tenderers' technical capacity (based on points 5 and 6 of the tender
form for a supplies contract):
— tenderers must be the official manufacturers or the authorised dealers
of a vehicle manufacturing or assembly company,
— tenderers must have delivered and provided maintenance for vehicles of
the same make, in equal or greater quantities, at least 3 times over the
past 3 years.
17. Award criteria: Price.

18. Procedures for obtaining the invitation to tender dossier: The
invitation to tender dossier is available from the following web address:

It can also be obtained from the contracting authority. The standard
tender form for a supplies contract must be used to draw up tenders. This
form can be found in the invitation to tender dossier, and its clauses and
format must be strictly adhered to.
Any questions concerning this invitation to tender must be sent in writing
to the 'Cellule d'appui à l'ordonnateur national (CELON)', 42 bis, avenue
de Grèce, Bujumbura, at least 21 days before the final date for submission
of tenders in point 19. The contracting authority must reply to questions
at least 11 days before the final date for submission of tenders.
Clarifications concerning the invitation to tender dossier may be
published on the EuropeAid web site: http://ec.europa.eu/europeaid/cgi/
frame12.pl.
19. Final date for submission of tenders: 31.10.2008 (9:00), Burundi
local time.
Tenders received after this deadline will not be considered.
20. Tender opening session: 31.10.2008 (9:30).
21. Language for the procedure: French must be used for all
correspondence concerning this invitation to tender.
22. Legal basis: ACP-EC Partnership Agreement signed in Cotonou on
23.6.2000, as amended in 2005.
Decision No 2/2002 of the ACP-EC Council of Ministers published in OJ L
320 of 23.11.2002.
