Contract specifications
6. Type of contract: Unit-price contract.
7. Contract description: This contract involves setting up a technical
assistance unit comprising 6 long-term experts for the EDF National
Authorising Officer support facility. Of these 6 experts, 3 will have
extensive knowledge and experience of the specific Central African context
and will be responsible for the planning, briefing, implementation,
supervision and monitoring regarding operations in general, and more
specifically in their specialised spheres of competence (seconded Central
African civil servants may be recruited). The other 3 experts will have
extensive international experience in an EDF context and will also have
more specific responsibilities concerning skill support and transfer
vis-à-vis the first 3 experts and national civil servants involved in the
process. The experts' profiles shall be closely related to economics,
financial and accounting management, land management, civil engineering,
and local development.
8. Number and titles of lots: 1 lot (36 months): technical assistance to
the EDF National Authorising Officer support unit.
9. Maximum budget available: EUR 1 500 000.
10. Object of additional services: Subject to the availability of
funding, the contracting authority may decide, at its own discretion, to
extend the term of the project and/or its object up to a maximum amount
not exceeding the initial contract value and duration. Any contract
extension is subject to satisfactory performance by the contractor.
Conditions for participation
11. Eligibility: Participation in contract procedures is open on equal
terms to natural persons and legal entities (irrespective of whether they
are taking part as individuals or as part of a grouping (consortium) of
tenderers) from the ACP countries and the Member States of the European
Union, and also to international organisations as authorised by the
instruments applicable to the programme under which the contract is
financed (see also point 30).
12. Application: Any eligible natural person or legal entity (as defined
in point 11) or grouping of said parties (consortium) may apply.
A consortium can be a permanent grouping with legal status or an informal
grouping created with a specific invitation to tender in mind. All the
members of a consortium (i.e. lead company and all other members) shall be
jointly and severally liable vis-à-vis the contracting authority.
Should an ineligible natural person or legal entity (as defined in point
11) take part, the application concerned will be automatically
disqualified (in particular, the application from the whole consortium
where said party belongs to a consortium).
13. Number of applications: Natural persons or legal entities can only
submit 1 application irrespective of whether they take part as a sole
legal entity, or as a lead company or member of a consortium submitting an
application. Should a natural person or legal entity submit more than 1
application, all the applications involving said party will be
disqualified.
14. Prohibition on alliances between shortlisted candidates: Tenders
which include companies not mentioned on the application forms used to
compile the shortlist will be disqualified from this restricted procedure.
Candidates invited to tender may not form alliances or subcontract to each
other for the contract in question.
15. Grounds for exclusion: Candidates must sign and enclose with their
application the statement provided in the standard application form
confirming that they are not in any of the situations described in section
2.3.3 of the Practical Guide to contract procedures for EC external
actions.
16. Subcontracting: Subcontracting is the only form of collaboration
authorised with companies who are not on the shortlist; tenderers must,
however, explicitly state that the contract will remain their
responsibility. If tenderers intend subcontracting 1 or more parts of the
services, this must be clearly stated in the tender submission form.
However, even though subcontracting is permitted, shortlisted candidates
must undertake to provide the major part of the services themselves. The
total value of subcontracted services must not exceed 25 % of the contract
value and the subcontractor cannot then further subcontract the services.
All subcontractors must, in addition, meet the eligibility criteria.
17. Number of candidates invited to tender: A minimum of 4 and a maximum
of 8 candidates will be invited to submit detailed tenders for this
contract, depending on the applications received.
Provisional schedule for activities
18. Scheduled date for dispatch of invitations to tender: 17.11.2008.
19. Provisional start date for the contract: 30.3.2009.
20. Initial contract length, and possible extension: 36 months.
Selection and award criteria
21. Selection criteria: The selection criteria must be clear and
non-discriminatory, and may not extend beyond the scope of the contract.
The documentary proof to be requested for the various selection criteria
must be taken into account. See section 2.4.12 of the Practical Guide to
contract procedures for EC external actions.
The following selection criteria will be applied to candidates. Where
applications are submitted by a consortium, then the criteria will apply
to the consortium as a whole.
(1) Candidates' economic and financial capacity (based on point 3 of the
application form):
(a) candidates' average annual turnover for the past 3 years must have
been at least EUR 1 000 000;
(b) cash and cash equivalents at the beginning and end of the financial
year must be in surplus, overall.
(2) Candidates' professional capacity (based on points 4 and 5 of the
application form):
(a) at least 2 of the candidates' staff must be currently working in
fields connected with this contract;
(b) at least 20 % of those employees working for candidates this year in
fields connected with this contract must be on permanent contracts.
(3) Candidates' technical capacity (based on points 5 and 6 of the
application form):
(a) candidates must have proven experience in at least 1 of the following
fields: technical assistant for the National Authorising Officer,
technical assistant for development programmes and projects, coordination
of technical assistance, training, programming;
(b) candidates must have achieved good results during the past 3 years
(9/2005–8/2008) for at least 1 completed project with a budget of at least
that of this contract and in fields related to this contract, namely
technical assistance to the National Authorising Officer or technical
assistance to development projects and programmes.
Candidates' projects in progress will also be taken into account for this
criterion. The proportion of each project's budget carried out in 8/2008
must be equal to or greater than the budget of this contract and in fields
related to this contract, namely technical assistance to the National
Authorising Officer or technical assistance to development projects and
programmes. Candidates must prove that good results will be achieved for
said project(s).
Economic operators may, if necessary and for a specific contract, make use
of the capacities of other bodies irrespective of the legal nature of the
connection between themselves and said bodies. In such an event, they must
provide the contracting authority with proof that they will have the
resources needed to carry out the contract by, for example, producing a
written commitment by said bodies to make such resources available. Such
bodies, e.g. economic operators' parent companies, must observe the same
eligibility rules, notably regarding nationality, as the economic
operators themselves.
If more than 8 applications prove to be eligible, i.e. meet all the
selection criteria, then the strengths and weaknesses of these candidates'
tenders will need to be re-examined to determine which 8 applications for
the invitation to tender are the most suitable. Only the following factors
will be considered in the re-examination:
(1) highest number of projects carried out in accordance with point
21.(3)(b);
(2) the number and budget of projects financed by the EDF and which are in
progress or have been completed by candidates in the field of technical
assistance to the EDF National Authorising Officer.
22. Award criterion: Economically most advantageous tender.
Application submission procedures
23. Final date for receipt of applications: 27.10.2008 (10:00), local
time (GMT+1).
Applications received after this deadline will be rejected.
24. Application submission procedures and information to be supplied: The
standard application form must be used for applications. This form is
available from the following web address:

index_fr.htm. The clauses and format of this form must be strictly adhered
to.
Additional documentation (brochure, letter, etc.) enclosed with the
application will not be considered.
25. Procedures for dispatch of applications: Applications must be drawn
up in French and sent solely to the contracting authority:

The contract title and the contract notice number (see point 1) must be
clearly marked on the envelope containing the application and must be
quoted in all subsequent correspondence with the contracting authority.
Applications submitted in any other way will not be considered.
26. Amendments to or withdrawal of tenders: Tenderers may amend or
withdraw their tender by giving notice thereof in writing before the final
date for submission of tenders. Tenders cannot be amended once this
deadline has passed.
Notice of amendments or withdrawal must be drawn up and sent as per the
instructions given in point 25.
The word 'modification' (amendment) or 'retrait' (withdrawal), as
applicable, must be written on the outside envelope and on the appropriate
inner envelope.
27. Working language: All correspondence concerning this invitation to
tender procedure and contract must be in French.
28. Additional information: Not applicable.
29. Date of publication of the corresponding contract forecast:
31.8.2007.
30. Legal basis: Partnership Agreement signed in Cotonou on 23.6.2000, as
amended in 2005.
